Under New York law there are three primary classifications of burglary charges. All of them are felonies. At a minimum, burglary is a class "D" felony. Higher felony offense levels occur when the building is a dwelling (a place where people commonly sleep), when the person uses a weapon or dangerous instrument, when a person displays what appears to be a firearm, and when an a person other than a participant is injured. Even being in possession of burglary tools, without having yet committed a burglary, could result in misdemeanor charges and up to a year in jail.
